Safeguarding Children: Making Adoptions and GUARDIANSHIPs Happen

Guardianships and adoptions are two completely different types of cases which are guided by completely different sets of laws, both of which ultimately look to furthering the best interests of children.

Adoptions are permanent, creating in the adopting parent(s) all of the parental rights and obligations as the child’s parents. In adoptions, the birth parents’ rights are permanently severed, either voluntarily or involuntarily.

Guardianships are in place to protect minor children for so long as necessary when the child’s parents are not in a place where they can adequately care for their child.

Adoptions:

Adoption is a great way to make a difference in a child's life by giving him or her a permanent home and loving parent(s). Although we do not get involved with locating and matching children to prospective adopting parents, we work tirelessly with those prospective parents who have already associated with a child and are looking to secure their rights as a parent or parents.

Guardianship

Becoming a legal guardian to a child is very rewarding. Considering Guardianship

If you are considering becoming a legal guardian for a child, make sure you have the right attorney to consult with throughout the process. The Probate court is empowered with approving petitions for guardianship when one or both parents are unable to care for their child. The court will then evaluate you and your home to determine whether you are a suitable guardian for the child or children. The guardian must always act in the best interest of the children, and must make a report to the court on an annual basis.

Emergency/Interim Orders

When warranted due to Domestic Violence, Civil Harassment, child safety, or other pressing concerns, temporary and/or interim orders are frequently issued by the court.
